Action Requested: Consider the rezoning request and make a recommendation to approve, approve with conditions or deny to the Union County Board of Commissioners.
Background:

This is a request to amend the Zoning Map of Union County by rezoning a parcel of land from R-40 (Residential, 40,000 square foot minimum lot size) to B2 CZ (Community Business, Conditional District). The applicant requests the rezoning in order to develop the property as a small community business center of approximately 8,100 square feet. Uses on the site, if approved, would be limited to Personal Improvement Services, Retail Sales and Eating Establishments. Since this is a conditional rezoning request the district is bound by all conceptual plans and conditions approved as part of the process. The applicant has submitted a detailed conceptual plan along with proposed building elevations and limitations on uses. In addition to these restrictions the applicant is also dedicating right-of-way to the NCDOT for the future widening of Providence Rd.

Action Requested:Consider the rezoning request and make a recommendation to approve, approve with conditions or deny to the Union County Board of Commissioners.
Background:

This is a request to amend the Zoning Map of Union County by rezoning a parcel of land from RA-40 (Residential Agricultural, 40,000 square foot minimum lot size) to R-4 (Residential, 4,000 square foot minimum lot size). The applicant requests the rezoning in order to develop a maximum of 99 townhomes on the property. Since this is a conditional rezoning request the district is bound by all conceptual plans and conditions approved as part of the process.

8.Conditional Rezoning CZ-2017-011 (Corea)
Action Requested: Consider application and make a recommendation to the Board of County Commissioners
Background: This is a request to amend the Zoning Map of Union County by rezoning a parcel of land from R-40 (Residential, 40,000 square foot minimum lot size) to B-2 CZ (Community Business, Conditional District). The applicant requests the rezoning in order to use the existing residence as a business. Since this is a conditional rezoning request the district is bound by all conceptual plans and conditions approved as part of the process.

 

This property lies near the outer edge of a Neighborhood Center. Neighborhood Centers are located near concentrations of existing or planned residences; in areas with access to major thoroughfares and utilities.  Typical uses include grocery stores, retail establishments, restaurants and services. Mixed residential densities are also appropriate around commercial and retail uses.

 

This rezoning request is in conformance with the Union County Comprehensive Plan. There is a limited amount of development that could take place on the property based on the size of the lot. The lot is nonconforming since the acreage is below the minimum lot size and the house does not meet the setbacks of the current zoning district. The B-2 does not have a minimum lot size requirement, however, the house does not appear to meet the setback requirements of the B-2 district either. If the existing house were to be demolished, it would be very difficult to build a new structure meeting all the current regulations on the property without obtaining a variance. Based on this nonconformity and the fact that the current house is on a septic system, the only way to use the property as a commercial use is to use the current house and a maximum of five parking spaces, as depicted on the conceptual plan. Based on this information staff recommends approval of the request.

9.Planning Board Schedule
Action Requested:  Consider rescheduling Planning Board meeting dates from the September 4th and November 6th meetings to another date.  In the past the board has chosen the following Tuesday as an alternative date. 

Background:  The Planning Board was provided a 2018 calendar of meeting dates for their regularly scheduled meetings on the first Tuesday of each month.  There are two meetings which have potential conflicts.  The County Commission meets on the first Monday of each month.  Occasionally a holiday will fall on their regular meeting date and the Commissioners will move their meeting to the following day (Tuesday) which conflicts with the Planning Board meeting.  September 3rd is a scheduled date for the Commissioners which is also a holiday.  This would mean that the Commissioners would move their meeting to September 4th which conflicts with the Planning Board meeting. 

 

Another potential concern is the November 6th Planning Board meeting date.  This is Election Day.  The Planning Board may wish to consider moving this meeting so that there is no conflict with that date.
